MSDS Exemption Statement for Molded Architectural Products

To whom it may concern:
Thank you for your inquiry regarding an MSDS for Arc Limited Molded Architectural Products. Please be aware that a MSDS does not exist for our products because they are considered an “Article” under the OSHA’s Hazard Communication Section 1910.1200 and are, as such, exempt from the MSDS requirement.
Paragraph 1910.1200(b) outlines “scope and application” of the Section. Paragraphs 1200(b)(6) and 1910.1200 (b)(6)(v) state that the Section does not apply to “Articles” as defined in paragraph (c). It says:
An “article” means a manufactured item other than a fluid or a particle: (i) which is formed to a specific shape or design during manufacture (ii) which has end use function(s) depend in whole or in part upon its shape or design during end use; and (iii) which under normal conditions of use does not release more than very small quantities, e.g. minute or trace amounts of a hazardous chemical (as determined under paragraph (d) of this section), and does not pose a physical hazard risk to employees.
OSHA realizes that manufacturers often provide MSDSs for reasons other than those of meeting the requirements of the HSC and that this can cause confusion to downstream users.
